Privacy Notice
In compliance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de Particulares, hereinafter the “Law”), Román, Morales y Salazar (hereinafter “RMYS”) with domicile in Bosque de Duraznos 65 Int. 607-A, Colonia Bosques de las Lomas, Del. Miguel Hidalgo, Ciudad de México CP 11700, hereby outlines the privacy policy and handling of personal data, seeking at all times that treatment thereof be legitimate, controlled and informed in order to guarantee the privacy of data provided.
“RMYS”, through its site www.rmys.mx (hereinafter the “Site”), among others, aims to protect the personal data and sensitive personal data, as the case may be, provided by the visitors and users of the Site or collected through any other means; as well as to comply with the legitimacy, consent, information, quality, purpose, loyalty, proportionality and accountability principles when handling such data (hereinafter the “Information”). Therefore, “RMYS” has set forth the following provisions for purposes of protecting such information.
Personal data provided by any visitor and/or user, including without limitation, subscribers, clients, suppliers and/or users and the general public, to “RMYS”, shall be used, by way of example but not limited to, as set forth below:
The personal data shall be used for purposes of providing, retaining and quoting products and services, including those of legal representation, to carry out all kind of proceedings and render opinions or reports in connection with any matter entrusted to “RMYS”, as well as to access the promotions and information contained in the Site, to provide materials owned by “RMYS” and to assess the quality of “RMYS” products and services, and to establish a more direct contact with the users and/or visitors of the Site and “RMYS” clients in any matter of interest.
“RMYS” collects the information through different means, including by way of example but not limited to, registrations to the Site, files, promotions, written means, among others.
The information requested to the Site’s users or visitors includes, by way of example but not limited to, name(s), last name(s), email addresses, telephone, address, employment data, among others, as may be requested by “RMYS”, which shall not be deemed as sensitive data as provided in the Federal Law on the Protection of Personal Data Held by Private Parties.
“RMYS” may pass on Information provided by its clients and/or user to third parties with which “RMYS” holds a legal relationship. Furthermore, “RMYS” may collect information based on the likes, preferences and in general use given by its clients and/or users and/or visitors of the Site. Such information, as well as Information provided by the clients and/or users and/or visitors, may be used for different commercial purposes, such as to provide statistical data, send information to clients and/or users and/or visitors of the Site in accordance with their specific interests, conduct market researches, and other activities or promotions that “RMYS” deems convenient. “RMYS” may also disclose Information when required pursuant to law and/or requested by a competent authority, or because, in good faith, it deems such disclosure to be necessary in order to: i) Comply with legal proceedings; ii) Respond to claims involving any content that damages third parties, or iii) Protect the rights, properties or safety of “RMYS”, its users and the public in general.
“RMYS” may provide the Information to any authority that requests so, as well as to file any defense on its behalf, and to establish protection measures against unlawful activities or situations that imply a risk to the safety of any person, as well as any other activity required by law or any authority.
“RMYS” expresses its commitment to protect the safety of the Information provided by its clients and/or users and/or visitors of the Site. To that effect, it uses safety procedures to prevent, insofar as possible, unauthorized access, use or disclosure.
The users and/or visitors, as well as any third party that provides personal data to “RMYS” are entitled to and may exercise the rights to access, rectify, cancel and update their Information, including their email address, as well as to disagree with the treatment given to the Information, in accordance with applicable laws. The users and/o visitors and/or third parties, guarantee and are liable for, in any event, the truthfulness, accuracy and effectiveness of the Information they provide, and undertake to keep it updated.
In certain cases, “RMYS”, at its discretion, shall keep in its files Information that the user has requested be removed for purposes of resolving any disputes or claims, detect problems or issues and resolve them, for a period of time determined by Law. In any event, the Personal Information of a client or user will not be immediately removed from “RMYS” files for legal an technical reasons, including safety support systems. Therefore, users shall not be expected that all Information be permanently deleted from “RMYS” databases immediately upon request.
If the client, user and/or visitor wishes to exercise their right to access, rectify, cancel or disagree, such rights may be at any time exercised by directing a request to (i) contacto@rmys.mx and/or (ii) to the referred address or at (55) 4432-4445, Monday through Friday from 09:00 to 18:00, during business days, as applicable. For the foregoing purposes, the client, user and/or visitor must represent before “RMYS” to reliably know the personal data that the user wishes to rectify, cancel or review, as well as the reason for providing such Information and in general must comply with the requirements et forth in article 29 of the Federal Law on the Protection of Personal Data Held by Private Parties.
Any changes to this privacy notice may be consulted in rmys.mx/aviso-de-privacidad; such notice may be at any time modified and it is your responsibility to consult this notice and its modifications.
